Flamyngo takes your privacy very seriously and treats all personal information with great care. In order to guarantee your privacy Flamyngo always acts in accordance with the Data Protection Act. This document sets out Flamyngo’s Privacy Policy. Flamyngo therefore recommends that you read this Privacy Policy carefully. The capitalized words are defined in the Terms of Service.

We have drafted this Privacy Policy with care and with the help of legal professionals. Should anything in the Privacy Policy be unclear, please do not hesitate to contact us at legal@flamyngo.co.

1. Who is Flamyngo?

Flamyngo B.V. (“Flamyngo”) is a private company with limited liability established and existing under the laws of The Netherlands, having its registered office in Amsterdam, the Netherlands, at Watertorenplein 4B, 1051 PA, registered with the Chamber of Commerce under number 64174034. Flamyngo offers an online Service through the Application and the Website www.flamyngo.co. The purpose of the Service is to enable you to create personalized, social travel guides consisting of Content posted by you or by other Users, which can be shared between the Users of the Service and/or by other media, such as blogs or social media platforms. Users can also search for Content of other Users.

2. What information does Flamyngo collect and process?

To allow you to use the Service, Flamyngo will collect personal information about you. In this paragraph we will describe what personal information Flamyngo collects and to what end Flamyngo collects your personal data.

Account

Before you can use the Service, you must create an Account on the Website or in the Application. To create an Account you need to provide Flamyngo with your Login Details. Your Login Details consists of:

• a combination of your email address and a password; or
• your Facebook credentials.

In order to create an Account you need to provide at least your first and last name. In addition, you can (voluntarily) add certain information to your account, such as:

• a personal photo;
• the city you live in;
• your year of birth;
• your gender.

When you use the Service, Flamyngo may also process other information about you, for instance your location and your personal preferences.

Flamyngo saves and processes all the supplied information. Any personal data you add to your Account is visible to other Users of the Service. You can change the information in your Account at any time on the Website or in the Application. After termination of your Account Flamyngo shall automatically make your Account inaccessible and remove your Account. In such case, the Content you have saved and any other Content will remain available in the Service. Upon your first request, Flamyngo will remove or anonymize this Content. Link to social media and other third party services: You may choose to link the Service to your Facebook account or to other third party software, or to use social media services or other third party software when using the Service. For the use of social media and third party software, you are bound by the conditions for use and privacy policies of these services. Flamyngo has no control over such third parties and thus can not guarantee that these third party services use your personal data in accordance with applicable legislation.

3. Does Flamyngo use cookies?

Flamyngo uses cookies on the Website and in the Application. Cookies are small text files that are placed on the hard drive or in the memory of computers or mobile devices. The cookies that are stored through the Website and Application cannot harm your computer or mobile device, or any files that are saved on this equipment.

Flamyngo uses functional cookies. These cookies are necessary to provide the services you request. For instance, functional cookies allow you to proceed through different pages of a website with a single login and they remember selections in language choice and (order) forms that are filled out on websites. In case Flamyngo uses tracking cookies, such as Google Analytics, your permission will explicitly be asked.

Delete cookies

The consent you have given to store and read cookies, can be withdrawn at any time by setting your browser to disable cookies and/or to remove all cookies from your browser. Please consult the help-function of your browser to learn how you can delete cookies. Please take into account that deleting cookies may cause some parts of the Website and Application to work incorrectly.

Note: refusing or deleting cookies only affects the computer and the browser on which you perform this action. If you use different computers and/or browsers you will need to repeat the above described actions on these computers and/or browsers. If you wish to use cookies, make sure you log-out of your Account when you leave a computer for public use.

4. For what purposes will Flamyngo use information about you?

Flamyngo may use your personal information for the following purposes:

• To allow you to use the Service via the Website and the Application;
• To communicate with you about the Service, your Account, Flamyngo and/or its products;
• To configure the Website and Application to your wishes and needs;
• To generate statistical data;
• To protect, adjust and update the Website and the Application.

Use by third parties

Flamyngo may provide your personal data to third parties only if this is necessary to perform the Services requested by you. The transfer of your personal data may include the transfer to external hosting providers of Flamyngo.

Flamyngo may also provide your personal data to third parties if you have given explicit consent to do so and/or if the information cannot in any way be traced to you. Also, Flamyngo may provide your personal data to third parties if Flamyngo is obliged to do so on account of national or international laws, case law and/or regulations, if Flamyngo considers it necessary to do so in defense of its own rights.

The Website and/or the Application may contain hyperlinks that navigate you from the Flamyngo environment to the website or application of a third party. Flamyngo has no authority over the services and/or websites of third parties to which is linked on the Website and/or the Application. It therefore may be the case that for the use of those services and/or websites of third parties another privacy policy is applicable. This Privacy Policy is exclusively applicable to the personal data that is obtained through the Application and the Website of Flamyngo. Flamyngo does not accept any responsibility or liability for the (use and/or content of the) services and/or websites of third parties.

5. How does Flamyngo protect your personal information?

Flamyngo takes appropriate technical and organizational measures to protect your (personal) information against loss or any form of unlawful use.

6. How can I view, change and delete my data?

If you wish to know what information Flamyngo has collected about you or if you wish to change data that you cannot change yourself in your Account, you can send a request for information on your personal data to: legal@flamyngo.co. Flamyngo will respond to your request within four (4) weeks. If you then wish to correct, add, remove or screen your personal data, you may send another request thereto. Flamyngo will then respond within four (4) weeks to such a request. If Flamyngo decides to deny your request, it shall inform you on the grounds of this decision.

7. Can this Privacy Policy be changed?

It is possible for the Privacy Policy to be amended in the future. That would then be mentioned on this page, or via the Service. It is therefore recommended to regularly visit the section on the Website or Application in which we outline the Privacy Policy.
